First, it is necessary to point out that the cookies used for information society and electronic commerce (hereinafter LSSI) are excluded from compliance with the obligations established in article 22.2 of Law 34/2002, of July 11, on cookies used to any of the following purposes:

Only allow communication between the user’s equipment and the network.
Strictly provide a service expressly requested by the user.

In this sense, the AEPD Working Group of Article 29 in its Opinion 4/2013 has interpreted that among the excepted cookies would be those that have as their purpose:

  • “User input” cookies
  • Authentication or user identification cookies (session only)
  • User security cookies.
  • Multimedia player session cookies.
  • Session cookies to balance the load.
  • User interface personalization cookies.
  • Complement cookies (plug-in) to exchange social content.

Thus, it can be understood that these cookies are excluded from the scope of article 22.2 of the LSSI and, therefore, it would not be necessary to inform or obtain consent about their use. On the contrary, it will be necessary to inform and obtain consent for the installation and use of any other type of cookies, both first and third party, session or persistent, being subject to the scope of Article 22.2 of the LSSI.

In the event that personal data is collected from users by means of cookies other than those indicated, these cookies should be notified before these cookies are activated.

The regulations do not specify ways to inform and obtain consent, nor is there a single formula to fulfill that duty, but there are multiple systems to achieve it. A simple way to fulfill your duty of information about cookies is through a system called “information by layers”.

In this way, when the user accesses your website, the essential information is shown in a first layer and, if you want to complete the information, you are provided in a second layer, which you would access when you click on a button or link.
